Terms of Use

1. Licence

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple-branded devices that you own or control, in line with the Usage Rules of the Apple Media Services Terms and Conditions. You may not copy, sell, sublicense, reverse engineer or attempt to extract the source code of the App, except where that restriction is prohibited by law.

2. Accounts

• Registering creates a new company team and makes you its administrator. Employees join only when an administrator invites them.
• Accounts are personal. Keep your password confidential and do not let anyone else clock in or out on your behalf.
• You must give accurate information and keep it up to date.
• Tell us at xcats@yahoo.com.hk immediately if you believe your account has been used without your permission.

3. Acceptable use

You agree not to:

• Falsify attendance, spoof or simulate your device's location, or help anyone else do so.
• Use the App to monitor people unlawfully, or for any purpose that breaks the labour, privacy or surveillance laws that apply to you.
• Interfere with, overload, probe or attempt to gain unauthorised access to the App or its servers.
• Upload unlawful, offensive or infringing content, including as a profile photo.

4. Employer responsibilities

If you use the App as an administrator, you are responsible for how your organisation collects and uses staff attendance and location data. That includes telling your staff what is recorded, obtaining any consent your local law requires, and honouring their data rights. The App is a record-keeping tool: it is not legal, payroll or tax advice, and you should check calculated hours before using them to pay wages.

5. Location and device permissions

Clock-in verification needs location permission. You can refuse or withdraw it in iOS Settings, but site verification will then be unavailable and your administrator may not accept the punch. GPS accuracy depends on your device, surroundings and network, so we cannot guarantee that every location reading is exact.

6. Availability and offline use

Punches made offline are stored on your device and uploaded when a connection returns. We aim to keep the service available at all times but it may be interrupted for maintenance, updates or reasons outside our control, and we may change or discontinue features.

7. Subscriptions and price

All features of the App — team scheduling, attendance reports, PDF export and unlimited work sites — are included in a single auto-renewing subscription sold through Apple's in-app purchase system: HK$38 per month or HK$388 per year, each starting with a 7-day free trial.

Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage your subscription or turn off auto-renewal at any time in your App Store account settings; cancelling keeps all features until the end of the paid period.

8. Intellectual property

The App, its design, name and icon belong to us and are protected by intellectual property law. Your attendance data belongs to you and your employer; using the App gives us no ownership of it.

9. Termination

You may stop using the App and delete your account at any time by contacting us. We may suspend or terminate access if these Terms are breached or if we are required to do so by law. Sections that by their nature should survive termination, including disclaimers and liability limits, continue to apply.

10. Disclaimer and limitation of liability

The App is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted or error-free, or that location readings and calculated hours will always be accurate.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost wages, or loss of data. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the App in the previous twelve months or HKD 100. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Apple

• These Terms are between you and us only, not with Apple. We alone are responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price; to the maximum extent permitted by law Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim relating to the App, including product liability, regulatory compliance or third-party intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

12. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules, and the courts of Hong Kong have non-exclusive jurisdiction. If mandatory consumer law in your country of residence gives you stronger protection, that law still applies to you.

3. 恰當使用

你同意不會：

• 偽造考勤、欺騙或模擬裝置位置，或協助他人這樣做。
• 利用本應用程式非法監察他人，或用於違反適用的勞工、私隱或監察法律的任何目的。
• 干擾、超載、探測或試圖未經授權存取本應用程式或其伺服器。
• 上載違法、冒犯或侵權的內容，包括作為大頭照。

4. 僱主責任

如你以管理員身份使用本應用程式，你須就貴機構收集及使用員工考勤和位置資料的方式負責，包括告知員工記錄了什麼、按當地法律要求取得同意，以及尊重其資料權利。本應用程式只是記錄工具，並非法律、薪酬或稅務意見；在以計算時數支付工資前，請先行核對。

5. 位置及裝置權限

打卡位置核對需要定位權限。你可以在 iOS 設定中拒絕或撤回，但考勤點核對功能將無法使用，你的管理員也可能不接納該次打卡。GPS 準確度取決於裝置、環境和網絡，我們無法保證每次定位都完全準確。

6. 服務可用性及離線使用

離線打卡會先儲存在裝置上，恢復連線後自動上載。我們力求服務全天候可用，但可能因維護、更新或我們無法控制的原因中斷，亦可能更改或停止某些功能。

7. 訂閱及價格

本應用程式的全部功能（團隊排班、考勤報告、PDF 匯出及無限考勤點）包含於單一自動續訂訂閱，透過 Apple 內購系統提供：每月 HK$38 或每年 HK$388，均附 7 天免費試用。

確認購買後將向你的 Apple ID 收費。除非你在當前期間結束前至少 24 小時取消，否則訂閱會自動續訂。你可隨時在 App Store 帳戶設定中管理訂閱或關閉自動續訂；取消後，所有功能仍可用至已付期間結束。

8. 知識產權

本應用程式及其設計、名稱和圖示屬我們所有，受知識產權法律保護。你的考勤資料屬於你和你的僱主；使用本應用程式不會令我們取得其擁有權。

9. 終止

你可隨時聯絡我們停止使用並刪除帳戶。如條款被違反或法律要求，我們可暫停或終止服務。因性質應在終止後繼續有效的條文（包括免責聲明及責任限制）仍然適用。

10. 免責聲明及責任限制

本應用程式按「現狀」及「現有」提供，在法律允許的最大範圍內不附任何形式的保證。我們不保證應用程式不會中斷或無錯誤，也不保證定位讀數和計算時數永遠準確。

在法律允許的最大範圍內，我們不對間接或後果性損失、利潤損失、工資損失或資料損失承擔責任。在無法免除責任的情況下，責任以你在過去十二個月就本應用程式支付的款項或 100 港元中的較大者為限。本條款不會限制法律上不能限制的責任。

11. Apple

• 本條款僅在你與我們之間生效，與 Apple 無關。我們獨自對本應用程式及其內容負責。
• Apple 對本應用程式不承擔維護或支援義務。
• 如本應用程式未能符合任何適用保證，你可通知 Apple，Apple 將退還購買價款；在法律允許的最大範圍內，Apple 無其他保證義務。
• Apple 不負責處理與本應用程式有關的任何申索，包括產品責任、法規遵從或第三方知識產權申索。
• Apple 及其附屬公司是本條款的第三方受益人，可對你執行本條款。
• 你確認你並非位於受美國政府禁運的國家或被指定為「支持恐怖主義」的國家，亦不在美國政府的禁止或限制名單上。

12. 管轄法律

本條款受香港特別行政區法律管限，不適用衝突法規則，香港法院擁有非專屬司法管轄權。如你居住地的強制性消費者法律給予你更強保障，該法律仍然適用。
